Welcome to Emyu. By accessing or using the Emyu application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. Emyu is a multimedia creation tool that allows you to create PDF documents and video slideshows from your photos without requiring an account or registration.
1. Acceptance of Terms
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
2. Description of Service
Emyu provides the following features: (a) creation of PDF documents from selected images stored on your device; (b) creation of video slideshows from selected images with customizable transitions, durations, and effects; (c) local storage and management of your projects, images, PDFs, and videos; (d) optional in-app purchases of virtual coins used to unlock PDF and video creation actions within the App.
The App operates entirely on your device. No account or login is required to use core functionalities. Certain features may consume virtual coins, which can be earned initially or obtained through in-app purchases.
3. Eligibility
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you represent that you have obtained parental or guardian consent. The App is not intended for use in any jurisdiction where such use would be prohibited.
4. In-App Purchases and Virtual Currency
Emyu may offer in-app purchases of virtual coins. All purchases are final and non-refundable except as required by applicable law. Virtual coins have no monetary value and cannot be exchanged for cash. We reserve the right to modify pricing, coin amounts, or feature costs at any time. Purchases are processed through Apple App Store or Google Play Store, and their respective terms apply.
5. Your Content and License
You retain all rights to the photos, images, and content you use within the App. By using the App, you grant Emyu a limited, non-exclusive license to process such content solely to provide the App's features (e.g., PDF generation, video creation). Your content remains stored locally on your device unless you explicitly share it. We do not upload or store your content on our servers.
6. Prohibited Conduct
You agree not to: (a) use the App for any illegal purpose or in violation of any laws; (b) use the App to infringe or violate the rights of others; (c) attempt to reverse engineer, decompile, or disassemble the App; (d) introduce malware or interfere with the App's operation; (e) misuse in-app purchase mechanisms; (f) use the App to create content that is defamatory, obscene, or harmful.
Violation of these terms may result in termination of your access to the App.
7. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We disclaim all warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
You assume full responsibility for the content you create and share using the App.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMYU AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations may not apply to you.
9. Modifications
We may modify these Terms at any time. We will provide notice of material changes through the App or via other reasonable means. Continued use of the App after such changes constitutes acceptance of the modified Terms.
10. Termination
You may cease using the App at any time. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the App ceases, but provisions that by their nature should survive (e.g., disclaimers, limitations of liability) will remain in effect.
11. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in California. If you are a consumer, you may have rights under the laws of your residence that cannot be waived by this choice of law.
